Acceptable Use Policy

This Acceptable Use Policy ("Policy") sets out the rules for using the Kourses platform. It forms part of our Terms of Service and applies to all users, including Creators and Students.

By using Kourses, you agree to comply with this Policy. If you violate this Policy, we may suspend or terminate your account.

1. Our Approach

Kourses is a platform for creators to build and sell online courses, communities, and digital products. We support a wide range of topics and perspectives, but we have limits on what is acceptable.

We do not pre-approve content before it is published. Creators are responsible for ensuring their content complies with this Policy and all applicable laws. If we become aware of content that violates this Policy, we will take appropriate action.

2. Prohibited Content

You may not use Kourses to create, host, distribute, or sell any of the following:

2.1 Illegal Content

Content that violates any applicable law or regulation, or that promotes or facilitates illegal activity.

2.2 Child Exploitation

Any content that exploits, endangers, or sexualises children in any way. This includes images, depictions, or descriptions of child abuse or sexual abuse, content that presents minors in a sexual manner, and any attempts to collect personal information from children. We report such content to the relevant authorities.

2.3 Violence and Threats

Content that threatens, incites, glorifies, or promotes violence against any individual or group. This includes content that encourages terrorism, self-harm, or suicide.

2.4 Hate Speech

Content that attacks, demeans, or advocates for the exclusion or abuse of individuals or groups based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, age, or any other protected characteristic.

2.5 Harassment and Bullying

Content intended to harass, intimidate, threaten, or bully any individual, or that encourages others to do so.

2.6 Pornography and Explicit Sexual Content

Sexually explicit content created primarily for sexual gratification. This includes real, fictional, and simulated depictions of sexual acts.

2.7 Fraud and Deception

Content designed to deceive, defraud, or mislead others. This includes phishing, impersonation, fake testimonials, misleading income claims, pyramid schemes, and multi-level marketing recruitment.

2.8 Intellectual Property Infringement

Content that infringes the copyright, trademark, or other intellectual property rights of others. You must have the necessary rights or permissions for all content you publish.

2.9 Private Information

Sharing someone's private or personal information without their consent (doxing), including addresses, phone numbers, financial information, or other identifying details.

2.10 Malware and Harmful Code

Content containing viruses, malware, spyware, or any code designed to damage, disrupt, or gain unauthorised access to systems or data.

2.11 Spam

Unsolicited bulk communications, including promotional messages sent without consent. This includes purchased email lists and deceptive marketing practices.

2.12 Misleading Health, Financial, or Legal Claims

Content making false or unsubstantiated claims about health treatments, financial returns, or legal outcomes, particularly where such claims could cause harm.

3. Platform Usage Restrictions

You must not:

  • Attempt to gain unauthorised access to Kourses systems, other users' accounts, or data
  • Interfere with or disrupt the platform, servers, or networks
  • Use automated tools, bots, or scripts to access or scrape the platform without permission
  • Reverse engineer, decompile, or attempt to extract the source code of any part of the platform
  • Circumvent any security measures, access controls, or usage limits
  • Use the platform to build a competing product or service
  • Resell, sublicense, or redistribute access to the platform without authorisation
  • Create multiple accounts to evade enforcement actions or abuse free trials
  • Use the platform in any way that could damage Kourses' reputation or operations

4. Fair Use

4.1 Our Unlimited plan offers generous allowances for storage, bandwidth, and platform usage. However, all plans, including Unlimited, are subject to fair use principles to ensure a quality experience for all users.

4.2 Fair use means using the platform in a manner consistent with typical usage patterns for an online course and community business. The vast majority of Creators will never encounter any limits.

4.3 Usage that may fall outside fair use includes:

  • Storage or bandwidth consumption significantly exceeding that of comparable Creators
  • Using Kourses primarily as a file hosting or media storage service rather than for delivering courses and communities
  • Automated or programmatic access that places excessive load on our systems
  • Activity that negatively impacts platform performance for other users
  • Practices designed to exploit unlimited allowances in ways not intended for normal business use

4.4 If your usage significantly exceeds normal patterns, we will contact you to discuss the situation. In most cases, we will work with you to find a solution, which may include optimising your usage or moving to a custom plan better suited to your needs.

4.5 We reserve the right to throttle, restrict, or suspend accounts that consistently exceed fair use limits after reasonable notice and an opportunity to address the issue, except where immediate action is required to protect platform performance.

4.6 We do not set specific numerical caps on the Unlimited plan, as fair use depends on context. If you anticipate unusually high usage (for example, hosting large volumes of video content or expecting rapid growth in student numbers), please contact us at team@kourses.com to discuss your requirements.

5. Creator Responsibilities

As a Creator using Kourses, you are responsible for:

  • All content you publish on the platform
  • Ensuring your content complies with this Policy and all applicable laws
  • Obtaining necessary rights and permissions for any third-party content you use
  • Your interactions with your Students
  • Complying with consumer protection, advertising, and data protection laws in the jurisdictions where you operate

Kourses does not endorse or guarantee any Creator content. The views and opinions expressed by Creators are their own and do not represent the views of Kourses.

6. Student Responsibilities

As a Student using Kourses, you are responsible for:

  • Using the platform and Creator content in accordance with this Policy
  • Respecting the intellectual property rights of Creators
  • Your interactions with Creators and other Students in community spaces
  • Not sharing, redistributing, or reselling content you have purchased without authorisation

7. Email and Communication

If you use Kourses to send emails or other communications to your audience, you must:

  • Only send communications to people who have given consent to receive them
  • Include a clear and working unsubscribe mechanism in all marketing emails
  • Comply with applicable anti-spam laws, including the UK Privacy and Electronic Communications Regulations (PECR), GDPR, and CAN-SPAM Act (if applicable)
  • Not use purchased, rented, or harvested email lists

We monitor email metrics including bounce rates, spam complaints, and unsubscribe rates. Excessive complaints may result in restrictions on your email capabilities or account suspension.

8. Reporting Violations

If you believe content on Kourses violates this Policy, please report it to us at:

When reporting, please include:

  • The URL of the content in question
  • A description of the violation
  • Any supporting evidence

We review all reports and will respond as appropriate. We may not be able to share details of actions taken due to privacy considerations.

9. Enforcement

If we determine that you have violated this Policy, we may take one or more of the following actions at our discretion:

  • Issue a warning
  • Remove or disable access to the offending content
  • Restrict specific features or capabilities
  • Suspend your account temporarily
  • Terminate your account permanently
  • Report illegal activity to law enforcement authorities
  • Pursue legal remedies

The action we take will depend on the nature and severity of the violation. Serious violations, including child exploitation, violence, and fraud, may result in immediate termination without warning.

If your account is suspended or terminated for a Policy violation, you will not be entitled to a refund of any fees paid.

10. Appeals

If you believe your content was removed or your account was suspended in error, you may appeal by emailing team@kourses.com within 14 days of the action. Please include:

  • Your account details
  • The content or action in question
  • Why you believe the decision was incorrect

We will review your appeal and respond within a reasonable timeframe. Our decision on appeals is final.

11. Changes to This Policy

We may update this Policy from time to time to reflect changes in our practices or legal requirements.

We will notify you of material changes by posting the updated Policy on our website and updating the "Last Updated" date.

Your continued use of Kourses after changes are posted constitutes acceptance of the revised Policy.
